 RULES AND PROCEDURES

OBJECTIVE

    To provide an entertaining, educational and profitable auction of magical paraphernalia, printed and video material to those registering for the event.

SPONSOR

    The LONE STAR MAGIC AUCTION is an assumed additional name of the LSMA Committee, Fort Worth, Texas who is the sole owner, operator and sponsor of this event.

TIME AND PLACE

    The LONE STAR MAGIC AUCTION is to be held on the 3rd Saturday in February at:

      MAGIC ETC.  
      2300 West Freeway at Forest Park Blvd.
      Fort Worth, Texas 76102

    The auction for 2010 will be held:

      Saturday, 20 February 2010.

AUCTION SCHEDULE

    Registration and Preview - 8:00am to 9:00am
    Silent Auction - 9:00am to 1:30pm
    Live Auction - 9:00am to Noon
    Luncheon Break - Noon to 1:00pm
    Live Auction - 1:00pm to 6:00pm

AUCTION REGISTRATION

    There is a $10.00 admission charge to everyone who attends the auction as a buyer or a seller.  The admission charge includes one auction catalog and a buyer/seller number. Extra catalogs may be purchased for $5.00 each.  There is no charge for admission to those not wishing a buyer/seller number or a catalog.

PRE-REGISTRATION

    Pre-Registration may be accomplished by sending the $10.00 admission fee to the LSMA mailed to MAGIC ETC. The Committee will mail the Registrant an Acknowledgment of his registration.  The Registrant should present his Registration Acknowledgment to the Registration Desk on the day of the Auction to receive his buyer/seller number and catalog.

SUBMITTING ITEMS FOR AUCTION

    There is no additional cost for submitting items for auction, although
    10% of all sales will be retained by LSMA Committee.

    Items submitted for auction must be received at MAGIC ETC. between December 1st and January 31st. Items received after January 31st  will be held for pick-up by the sender, until the last day of February of the year of the auction after which time they become the property of the LSMA Committee.

    Each seller may submit a maximum of 40 items. This includes any combination of live-auction and/or silent-auction items. The maximum is 40 items total.

    The seller may set a minimum bid for an item.  The minimum bid is understood to be that amount below which the item will NOT be sold.  If the item is not sold, the LSMA Committee will collect 10% of the minimum bid from the seller prior to the item being returned to the seller.  An unsold item with no minimum bid will be returned to the seller with no 10% charge.

    Once an item is received for sale, it may not be withdrawn prior to its being offered for bidding. Should time or other circumstances preclude the sale of an item, it will be returned to the seller.

    Any person who pays the Admission Charge of $10.00, including officers and members of the LSMA Committee and the auctioneers, may bid on items offered for sale. There will be no preferential treatment.

    It is the responsibility of the LSMA Committee to group items together as a single item for auction if the items are of such a nature as to warrant such action.

    All items submitted should be complete and have instructions.

     

CONDUCT OF THE AUCTION

    No smoking or alcoholic beverages are allowed in the Auction rooms.

    The auctioneer has full control over the conduct of the auction.

    The auctioneer's decision is final regarding the sequence of items to be presented for sale. 

    The auctioneer's decision is final regarding the acceptance of bids during the auction.

    The auctioneer's decision is final regarding the rejection of bids during the auction.

    Although the primary purpose of the auction is entertainment, participants are cautioned to take the bidding process seriously.  Intended "joke" bids will be accepted by the auctioneer and then are binding on the bidder. It is the bidder's responsibility to make the bid understood by the auctioneer.  If the auctioneer does not hear a bid, the bid does not count.

CHECK OUT BY BUYERS

    Live auction buyers may check out at any time during the auction but no sooner than 15 minutes after their last successful bid.

    Silent Auction buyers may check out after 3:00pm.

    At check out time, the buyers will be required to pay for the items that they have purchased in both the live and the silent auctions by cash, approved check, or credit card.  All successful buyers must pay for their items no later than the closing of the auction day.

    All purchases are final. All merchandise is sold on an "as is" basis. No refunds will be given.  All reasonable precautions will be taken to assure proper representation of items placed for sale. However, the LSMA Committee and its authorized representatives assume no responsibility or liability of any kind, including loss of items registered for sale.

    There will be a $25.00 charge for checks returned by banks for any reason including "Insufficient Funds". DO NOT MAKE BIDS IN EXCESS OF YOUR ABILITY TO PAY!

CHECK OUT BY SELLERS

    Sellers may check out at any time during the auction but no earlier than 15 minutes after the last successful bid for which they wish to be paid.

    Sellers who wish to check out before their item/s are auctioned will be mailed a check for the amount of the sales, less  the LSMA Committee 10% fee, within two weeks after the close of the auction.
